Your rights as a data subject

First of all, we would like to take this opportunity to inform you of your rights as a data subject. These rights are set out in Articles 15–22 of the GDPR. These include:

  • The right of access (Article 15 of the GDPR),
  • The right to erasure (Article 17 of the GDPR),
  • The right to rectification (Article 16 of the GDPR),
  • The right to data portability (Article 20 of the GDPR),
  • The right to restriction of processing (Article 18 of the GDPR),
  • The right to object to data processing (Article 21 of the GDPR).

To exercise these rights, please contact: datenschutz@paidi.de. The same applies if you have any questions regarding data processing within our organization or wish to withdraw your consent. You also have the right to lodge a complaint with a data protection supervisory authority.

Rights to object

Please note the following in relation to the right to object:

If we process your personal data for the purposes of direct marketing, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling, insofar as it is related to direct marketing.

If you object to processing for the purposes of direct marketing, we will no longer process your personal data for these purposes. The objection is free of charge and may be made in any form, preferably to: datenschutz@paidi.de.

In the event that we process your data to safeguard legitimate interests, you may object to this processing at any time on reasons relating to your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.

Purposes and legal bases for data processing

When processing your personal data, we comply with the provisions of the GDPR and all other applicable data protection regulations. The legal bases for data processing are derived in particular from Article 6 of the GDPR.

We use your data to initiate business relations, to fulfil contractual and statutory obligations, to perform the contractual relationship, to offer products and services, and to strengthen customer relationships, which may also include analyses for marketing purposes and direct marketing.

Your consent to data processing may also constitute a legal basis for data protection purposes. Before you give your consent, we will inform you of the purpose of the data processing and your right to withdraw your consent.

Disclosure to third parties

We will only disclose your data to third parties in accordance with statutory provisions or where you have given your consent. Otherwise, data will not be disclosed to third parties unless we are obliged to do so by mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement agencies).

Recipients of the data / Categories of recipients, transfers to third countries / Intention to transfer to third countries

Within our organization, we ensure that your data is only made available to those individuals who require it to fulfil contractual and legal obligations.

In certain cases, service providers assist our specialist departments in carrying out their tasks. The necessary data protection agreements have been concluded with all service providers. (iMi digital GmbH for the development, operation and maintenance of the website and the AI advisor; Hetzner Online GmbH for hosting in a data centre in Germany).

Furthermore, we will only disclose your data to other recipients or third parties within the meaning of the GDPR with your consent or in accordance with statutory provisions, in particular where we are obliged to do so by mandatory legal provisions.

Data will only be transferred to third countries (outside the European Union or the European Economic Area) insofar as this is necessary for the performance of the contractual relationship, is required by law, or you have given us your consent to do so.

We do not transfer your personal data to any service providers outside the European Economic Area.

Where data is transferred to third countries in connection with tracking and web analytics tools or other technologies used on our website, we will inform you of this individually when explaining the relevant technology further down in this privacy policy.

Data retention period

We store your data for as long as it is required for the respective processing purpose. Please note that numerous retention periods require that data continue to be stored. This applies in particular to retention obligations under commercial or tax law (e.g. the German Commercial Code, the German Fiscal Code, etc.). Unless further retention obligations apply, the data will be routinely deleted once the purpose has been fulfilled.

In addition, we may retain data if you have given us your consent to do so, or in the event of legal disputes, where we may use such data as evidence within the statutory limitation periods, which may be up to thirty years; the standard limitation period is three years.

Secure transmission of your data

To provide the best possible protection for the data we hold against accidental or deliberate manipulation, loss, destruction or access by unauthorized persons, we implement appropriate technical and organizational security measures. Security levels are continuously reviewed in collaboration with security experts and adapted to new security standards.

Data exchanged to and from our website is always encrypted. We use HTTPS as the transmission protocol for our website, always employing the latest encryption protocols. It is also possible to use alternative means of communication (e.g. by mailing).

Obligation to provide data

Various categories of personal data are necessary for the establishment, performance and termination of the contractual relationship and for the fulfilment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

We have summarized the details for you in the section mentioned above. In certain cases, data must also be collected or provided in accordance with legal provisions. Please note that it is not possible to process your enquiry or fulfil the underlying contractual relationship without the provision of this data.

Categories, sources and origin of the data

The specific context determines which data we process.

When you visit our website, we collect and process the following data:

  • Name of the internet service provider

  • Web browser and operating system used
  • The IP address assigned by your internet service provider
  • Files requested, volume of data transferred, downloads/file exports

  • For reasons of technical security (in particular to defend against attempted attacks on our web server), this data is stored in accordance with Article 6(1)(f) of the GDPR. After a maximum of 7 days, the data is anonymized by truncating the IP address, so that no link to the user can be established.

Automated individual decision-making

We do not use purely automated processing procedures to reach a decision.

Cookies (Article 6(1)(a), (f) of the GDPR, Section 25(1), (2) of the TDDDG)

Our website uses so-called cookies. These have the purpose to make our website more user-friendly, effective and secure. Cookies are small text files that are placed on your device and stored (locally) by your browser. Cookies contain only pseudonymous, and in most cases even anonymous, data. Some cookies remain in place for the duration of a browser session (so-called session cookies), whilst others are stored for a longer period (so-called persistent cookies, e.g. consent settings). The latter are automatically deleted after the specified period (usually 6 months). In addition to our own cookies, we also use cookies controlled by third-party providers. These providers use the information contained in the cookies, for example, to display content to you or to track the pages you visit.

Based on our legitimate interest (Article 6(1)(f) of the GDPR), we use technically necessary cookies that are essential for the operation of the website and to ensure its functionality. Furthermore, we use cookies without your consent where their sole purpose is to store or access information stored on your device for the transmission of messages, or where they are strictly necessary to provide the service you have expressly requested, in accordance with Section 25(2) of the German Telecommunications Data Protection Act (TDDDG).

Subject to your consent, further cookies are used which enable us or third parties, for example, to analyze how our services are used. This allows us to tailor content to users’ needs. Furthermore, cookies enable us to measure the effectiveness of a particular advert and to tailor its placement, for example, to users’ thematic interests. The legal basis for this is your explicit consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG).

You can withdraw your consent at any time via our consent banner, with effect for the future, and change your cookie settings. Please note that changes must be made separately for each device.

You can access your cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

If you have accounts with the third-party providers we use and are logged in to them, your data may be linked to the relevant account. You can prevent such linking by not giving your consent to the relevant cookies, by withdrawing your consent, or by logging out of the relevant third-party providers beforehand.

Most browsers accept cookies automatically. You can also disable, restrict or delete cookies on your device manually via your browser settings or using software. If you disable cookies, you will not be able to use our website to its full extent.

Please also note the information provided in the section relating to the specific service that uses cookies.

Friendly Captcha

On our website, we use the Friendly Captcha service provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee. This service is designed to protect our website from malicious automated access and input, particularly by so-called bots. This enables us, for example, to protect forms and other input fields from spam and other forms of misuse.

Friendly Captcha uses a so-called ‘proof-of-work’ procedure for this purpose. In this process, a computational task is transmitted in the background to the user’s device and solved there. This makes it possible to verify whether a request originates from a genuine user without the need to solve traditional CAPTCHA tasks. According to the provider, this process does not involve tracking user behavior or creating user profiles for analytical or marketing purposes.

When using Friendly Captcha, the IP address of the device being used is transmitted to the service for technical reasons. According to the provider, the IP address is anonymized using a one-way hash function before being stored. The processed data is used exclusively for security purposes and to distinguish between automated and human access.

Friendly Captcha states that it does not use HTTP cookies and does not permanently store any data in the user’s browser. According to the provider, no information is permanently stored on or read from the end device for tracking purposes.

The processing of personal data is carried out based on Art. 6(1)(f) GDPR. Our legitimate interest lies in protecting our website and the functions provided on it against automated attacks, malicious input and spam, as well as in ensuring the security and functionality of our systems.

Trustpilot

On our website, we provide a button linking to our company profile on Trustpilot, a review platform operated by Trustpilot A/S, Pilestræde 58, 5th floor, 1112 Copenhagen K, Denmark. We do not embed any Trustpilot reviews or widgets. Only when you click on the button will you leave our website and a connection to Trustpilot be established.

Trustpilot is responsible for data processing on the Trustpilot website. Further information can be found in Trustpilot’s privacy policy: https://legal.trustpilot.com/for-reviewers/end-user-privacy-terms.

Instagram feed

We embed content from our Instagram account on our website. Instagram is a service provided by Meta, Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.

The images displayed in our Instagram feed are not loaded directly from Instagram’s or Meta’s servers but are hosted on our own server and delivered to your browser from there. Therefore, simply visiting our website and viewing the Instagram feed does not establish a connection between your browser and Instagram or Meta. In particular, the mere display of the feed following our technical integration does not result in any data from your device being transmitted to Meta.

As no content is retrieved directly from Meta for the display of the Instagram feed, and as, following our technical integration, no information is stored on your device by Meta or read from it, there appears to be no access to your device by Meta within the meaning of Section 25 of the TDDDG merely through the display of the feed.

However, the posts contained in the feed may include external links to Instagram. If you click on such a link, you will leave our website and be redirected to Instagram. It is only at this point that a connection to Instagram is established. From this point onwards, further data processing by Meta takes place in accordance with the data protection provisions applicable to Instagram.

If you are logged in to Instagram, your use of Instagram may also be linked to your Instagram account. We generally have no influence over the data processing carried out by Meta after you have accessed the external Instagram page.

Insofar as personal data is processed when providing the Instagram feed on our website, this is carried out on the basis of Article 6(1)(f) of the GDPR. Our legitimate interest lies in providing our visitors with up-to-date content from our Instagram presence on our website, without establishing a direct connection to Meta as soon as they access our website. Data processing in connection with the subsequent visit to Instagram, however, is governed by Meta’s privacy policy.

Google Tag Manager

We use Google Tag Manager, a service provided by Google, Gordon House, Barrow Street, Dublin 4, Ireland, on our website. Google Tag Manager is used to manage and control so-called website tags. These tags enable further services and functions to be integrated into and controlled on our website.

Google Tag Manager acts as a management tool in this context. The personal data processed by the services integrated via Google Tag Manager depends on the specific service being used. We provide separate information about such services, in particular analytics or marketing services, in this privacy policy.

According to Google, Google Tag Manager collects certain aggregated data on tag firing in order, amongst other things, to monitor the stability and performance of the system, as well as the quality of the installation, and to enable diagnostics. Google states that this aggregated data does not contain any IP addresses or measurement IDs linked to a specific individual.

According to Google, data in standard HTTP request logs is deleted within 14 days of receipt.

Data processing is carried out on the basis of your consent in accordance with Article 6(1)(a) of the GDPR. Insofar as information is stored on your device or information already stored is read out during use, this is done on the basis of your consent in accordance with Section 25(1) of the TDDDG. In this context, we also use Google Consent Mode, which allows the respective consent status to be transmitted to Google tags and their behavior to be controlled accordingly.

You may withdraw your consent at any time with future effect by accessing our consent banner and deselecting the relevant consent option. Please note that the consent banner settings must be changed individually for each device.

You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

Google Tag Manager itself is not used to create user profiles for analytical or marketing purposes. Insofar as the services integrated via Google Tag Manager use cookies or similar technologies, access information on your device or process personal data for analytical or marketing purposes, the legal basis required for this depends on the respective integrated service.

When using Google Tag Manager, personal data may also be transferred to and processed in third countries outside the European Union or the European Economic Area, in particular the USA. Google is certified under the EU-US Data Privacy Framework.

Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (‘Google’). Google Analytics enables us to track and analyze user behavior on our website. This helps us to better understand how our website is used and to optimize our offering.

In particular, the following data may be processed: the user’s IP address, browser type and version, device type, operating system used, the time and duration of page views, and the referrer URL.

Data processing is carried out on the basis of your consent in accordance with Article 6(1)(a) of the GDPR. Insofar as information is stored on your device or information already stored is read out whilst using Google Analytics, this is carried out based on your consent in accordance with Section 25(1) of the TDDDG.

The data collected by Google Analytics is deleted or anonymized as soon as it is no longer required for our purposes. The collected data is automatically deleted or anonymized after 14 months.

You may withdraw your consent at any time with future effect by accessing our consent banner and deselecting the relevant consent option. Please note that the consent banner settings must be changed individually for each device.

You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

When using Google Analytics, personal data may also be transferred to and processed in third countries outside the European Union or the European Economic Area, in particular the USA. Google is certified under the EU-US Data Privacy Framework.

Store Locator / Google Maps

On our website, you can use our Store Locator to find a retailer near you where you can purchase our products. To do this, we use Google Maps, a mapping service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Maps enables us to display sales locations on an interactive map and show retailers near you. To do this, your device’s location function may be used to determine your current location. When using Google Maps, personal data is transmitted to Google. This includes, in particular, your IP address and, where applicable, your location data. In connection with the display of Google Maps, fonts (Google Fonts) are also loaded from Google’s servers once you have given your consent. In particular, your IP address is transmitted to Google in this process.

The Google Maps content is only loaded once you have consented to the use of Google Maps via our consent banner. Without your consent, Google Maps will not be loaded and no corresponding data will be transmitted to Google.

Data processing is carried out based on your consent in accordance with Article 6(1)(a) of the GDPR. Insofar as information is stored on your device or information already stored is read out while using Google Maps, this is carried out based on your consent in accordance with Section 25(1) of the TDDDG.

You may withdraw your consent at any time with future effect by accessing our consent banner and deselecting the relevant consent option. Please note that the consent banner settings must be changed individually for each device.

You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

When using Google Maps, personal data may also be transferred to and processed in third countries outside the European Union or the European Economic Area, in particular the USA. Google is certified under the EU-US Data Privacy Framework.

Google determines the retention period for personal data processed in connection with the use of Google Maps. Further details can be found at https://policies.google.com/technologies/retention. We store your consent for 30 days in the ‘neti-store-locator-google-consent’ cookie.

Further information on Google Maps can be found in the Terms of Service for Google services and the additional Terms of Service for Google Maps. Information on the processing of personal data by Google can be found in Google’s Privacy Policy.

Shopware Analytics

Our website uses Shopware Analytics, a web analytics tool provided by shopware AG, Ebbinghoff 10, 48624 Schöppingen, Germany.

Shopware Analytics enables us to record and analyze user behavior on our website. This helps us to optimize our offering, identify errors and improve user-friendliness. User data collected includes, for example, pages visited, click paths, operating systems, referrer URLs, browser data, the date and time of the page visit, and a truncated IP address. The data collected is anonymized after collection. The anonymized data is then processed by shopware AG for analysis purposes and forwarded to us. Data processing is carried out based on your consent in accordance with Article 6(1)(a) of the GDPR and Section 25(1) of the TDDDG.

You may withdraw your consent at any time with future effect by simply accessing our consent banner and deselecting the relevant consent option. Please note that the change must be made individually in the consent banner settings for each device.

You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

The data is stored for a period of 30 days (your consent in the ‘_swa_consent_enabled’ cookie) or until you withdraw your consent (the identifiers ‘_swa_anonymousId’ and ‘_swa_userTraits’ in your browser’s local storage).

No data is transferred to third countries. Further information on Shopware’s data protection policy can be found here: https://www.shopware.com/de/datenschutz/website/.

YouTube

We have embedded videos from the YouTube video portal on our website. The service provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Embedding YouTube enables us to make video content available to you directly on our website and to allow it to be played there.

The YouTube videos are embedded in what is known as ‘enhanced privacy mode’. The YouTube content is only loaded once you have consented to the use of YouTube via our consent banner. Without your consent, the embedded YouTube content will not be loaded and no corresponding data will be transferred to YouTube or Google.

If you consent to the use of YouTube, personal data will be transmitted to YouTube or Google. In particular, your IP address, referrer information and browser data may be processed. In addition, cookies may be stored on your device. If you are logged into your YouTube or Google account whilst visiting our website, Google may associate your use of the embedded content with your user account. You can prevent this by logging out of your YouTube or Google account before using the content.

Data processing is carried out based on your consent in accordance with Article 6(1)(a) of the GDPR. Insofar as information is stored on your device or previously stored information is read out whilst using YouTube, this is carried out based on your consent in accordance with Section 25(1) of the TDDDG.

You can withdraw your consent at any time with future effect by accessing our consent banner and deselecting the relevant consent option. Please note that the consent banner settings must be changed individually for each device.

You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas

When using YouTube, personal data may also be transferred to and processed in third countries outside the European Union or the European Economic Area, in particular the USA. Google is certified under the EU-US Data Privacy Framework.

Google determines the retention period for personal data processed in connection with the use of YouTube. Further details can be found at https://policies.google.com/technologies/retention. We store your consent for 30 days in the ‘youtube-video’ cookie.

Wishlist

On our website, you can save products to a wishlist. This is a standard feature of the Shopware software; we do not use any additional plug-ins for this purpose. A customer account is not required.

The wishlist is available once you have consented to the ‘Wishlist’ convenience feature via our consent banner. We store your consent for 30 days in the ‘wishlist-enabled’ cookie. The products added to your wishlist are stored in your browser’s local storage and remain there until you remove them from the wishlist or clear your browser’s website data. We do not store your wishlist on our servers; to display it, your browser simply transmits the numbers of the products on your wishlist to our server. We do not use the wishlist for product recommendations, tracking, advertising or reminder emails.

Insofar as personal data is processed in connection with the use of the wish list, such processing is carried out based on your consent in accordance with Article 6(1)(a) of the GDPR. The storage of information on your device or access to information stored there via cookies and local storage is carried out based on your consent in accordance with Section 25(1) of the TDDDG.

You may withdraw your consent at any time with effect for the future. You can access the cookie settings at any time via the link https://paidi.de/de/cookie/offcanvas.

The retention period is 30 days.

Social media links

On our website, you will find links to the social media services of Meta / Facebook, YouTube, Pinterest and Instagram. You can recognize links to the websites of these social media services by the respective company logo. If you follow these links, you will be taken to our company page on the relevant social media service. When you click on a link to a social media service, a connection is established with the servers of the social media service. This informs the social media service’s servers that you have visited our website. In addition, further data is transmitted to the provider of the social media service. This includes, for example:

  • The address of the webpage on which the activated link is located
  • The date and time the website was accessed or the link was activated
  • Information about the browser and operating system used
  • IP address

If you are already logged in to the relevant social media service when you click the link, the provider of the social media service may be able to use the data transmitted to identify your username and, in some cases, even your real name, and to link this information to your personal user account with the social media service. You can prevent this linking to your personal user account by logging out of your user account beforehand.

The servers of the social media services are located in countries outside the European Union. The data may therefore also be processed by the social media service provider in countries outside the European Union. Please note that companies in these countries are subject to data protection legislation which generally does not protect personal data to the same extent as is the case in the Member States of the European Union.

Please note that we have no influence over the scope, nature and purpose of the data processing carried out by the social media service provider. Further information on the use of your data by the social media services integrated into our website can be found in the privacy policy of the respective social media service.

Marketing purposes for existing customers (Article 6(1)(f) of the GDPR)

PAIDI Möbel GmbH is keen to maintain our customer relationship with you and to provide you with information and offers regarding our products and services. We therefore process your data in order to send you relevant information and offers by email.

If you do not wish to receive such communications, you may object at any time to the use of your personal data for the purposes of direct marketing; this also applies to profiling insofar as it is related to direct marketing. If you object, we will no longer process your data for this purpose.

You may object free of charge and without having to state a reason, and your objection should, if possible, be sent to 09391/ 501 401, by email to info@paidi.de or by mail to Hauptstraße 87, 97840 Hafenlohr.

People under the age of 16 may not provide us with any personal data or submit a declaration of consent without the consent of their legal guardians. We would like to encourage parents and legal guardians to take an active interest in their children’s online activities and interests.

Links to other providers

Our website also contains – clearly identifiable – links to the websites of other companies. Where links to websites operated by other providers are present, we have no influence over their content. Consequently, we cannot accept any liability or guarantee for this content. The respective provider or operator of the sites is always responsible for the content of these pages.

The linked pages were checked for any possible legal infringements and apparent breaches of the law at the time the links were created. No unlawful content was apparent at the time the links were created. However, it is not reasonable to expect us to monitor the content of the linked pages on an ongoing basis without specific evidence of a legal infringement. Should any legal infringements come to our attention, such links will be removed immediately.
